Terms of Service

1. Who we are
Fleetra is provided by AI & IT Solutions Marcin Gendek (sole proprietorship), registered in Poland, NIP: 7642718984. Contact: fleetraai@gmail.com. These Terms govern your use of the Fleetra web app and services (the "Service"). By creating an account or using the Service you accept these Terms.
2. Beta service
The Service is in beta and provided "AS IS" and "AS AVAILABLE". Features may change or be discontinued without notice.
3. Eligibility & accounts
You must be at least 18 and have authority to accept these Terms. Keep credentials confidential. You are responsible for activity on your account.
4. Your content
You may submit text/links and configure sources. You retain ownership of your content. You grant us a non-exclusive license to host/process it solely to provide and improve the Service.
5. Third-party content (e.g., X/Twitter)
The Service may surface summaries/insights based on third-party content. We do not control or guarantee accuracy. You must comply with third-party terms (e.g., X/Twitter). Do not use the Service to violate those terms or applicable law.
6. Acceptable use
No scraping that breaches third-party terms, no spam, malware, reverse engineering, or attempts to bypass security/rate limits. No unlawful, infringing, or harmful use.
7. Intellectual property
We and our licensors own the Service, including UI, models, and software. Except as permitted by law, you may not copy, modify, or create derivative works from the Service.
8. AI output
Outputs may be inaccurate or incomplete and are for informational purposes only—not financial, medical, or legal advice. You are responsible for how you use outputs.
9. Suspension & termination
We may suspend or terminate the Service or your account for breach or risk to the Service. You may stop using the Service at any time.
9A. Subscriptions & Payments
Paid plans are billed via Stripe on a recurring basis (monthly or yearly, as selected). Subscriptions renew automatically unless you cancel before the renewal date.
- Currency & Taxes: Prices are shown in USD and are exclusive of applicable taxes (e.g., VAT/GST). Taxes may be charged where required by law.
- Receipts & Invoices: Stripe sends payment receipts automatically. VAT invoices can be issued on request after providing valid billing details and tax ID.
- Upgrade: Upgrades take effect immediately; you authorize Stripe to charge a prorated amount for the remaining period.
- Downgrade: Downgrades typically apply at the end of your current billing period (features remain until then).
- Cancellation: You can cancel anytime from your account. Access remains until the end of the paid period, after which paid features are disabled.
- Failed payments: Stripe may retry charges and send reminders. If payment remains unpaid, access may be suspended or the subscription canceled.
- No reselling: You may not resell access to the Service without our written consent.
9B. Free Trials & Free Tier
We may offer a time-limited free trial and/or a free tier. Trials are limited to one per user and may not be repeated by creating additional accounts.
If you upgrade during a trial, billing starts immediately and the trial ends. After canceling a paid plan, you are not eligible for another trial.
9C. Pricing & Changes
We may change plan features or pricing prospectively. For material changes to an active subscription, we will provide reasonable notice and the change will apply on renewal. Continued use after the effective date indicates acceptance.
9D. Billing Disputes
If you believe there is an error, contact fleetraai@gmail.com within 30 days of the charge. Initiating a chargeback without contacting us may result in account suspension.
9E. Refunds
Fees are non-refundable except where required by law or if we expressly agree otherwise in writing. Partial-period refunds are not provided.
10. Disclaimers & limitation of liability
To the maximum extent permitted by law, we disclaim all warranties. We are not liable for indirect, incidental, special, or consequential damages, loss of profits, or data. Our aggregate liability is limited to the fees you paid in the past 3 months (or €0 for the free plan).
11. Indemnity
You will indemnify us for claims arising from your illegal use, violation of third-party rights or terms, or content you submit.
12. Changes
We may update these Terms. If changes are material, we will notify you. Continued use means acceptance. Keep an archive of versions.
13. Governing law & venue
These Terms are governed by the laws of Poland, without regard to conflict of laws principles. Any disputes shall be submitted to the courts competent for [miasto sądu]. Mandatory consumer protection rights in your country of residence remain unaffected.

You represent that you are not located in, under the control of, or a national or resident of any country or entity subject to sanctions or embargoes. You agree to comply with applicable export control and sanctions laws.
16. Copyright & takedowns
If you believe content accessible via the Service infringes your rights, contact us at fleetraai@gmail.com with sufficient details for evaluation; we may remove or disable access to allegedly infringing material.
17. Miscellaneous
- Entire agreement: These Terms constitute the entire agreement regarding the Service.
- Severability: If any provision is invalid, the remainder remains in effect.
- Assignment: You may not assign these Terms without our consent; we may assign them as part of a reorganization or sale.
- Notices: We may provide notices via the app or email. Electronic communications satisfy legal communication requirements.
18. Language
These Terms may be provided in multiple languages. In case of conflict, the English version controls.
